Terms of Service

Welcome to RapidSDLC, a brand of Neff Security Consultants, LLC, doing business as (“DBA”) RapidSDLC (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our software, website, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. By using our Services, you represent and warrant that you meet these requirements.

2. Account Registration

  • To access certain features, you must create an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized access or security breach.

3. Use of Services

You agree to use the Services only for lawful purposes and in compliance with all applicable laws, regulations, and third-party rights. You must not:

  • Attempt to interfere with, compromise, or circumvent any security feature of the Services.
  • Reverse engineer, decompile, or disassemble the Services.
  • Use the Services to transmit malicious code, spam, or other harmful material.

4. Service Availability & Uptime Guarantee

We aim to provide 99.5% uptime each calendar month. This guarantee excludes:

  • Scheduled maintenance (with at least 24 hours’ notice when possible).
  • Downtime caused by factors outside our reasonable control, including but not limited to force majeure events, internet provider failures, or third-party service disruptions.

If we fail to meet the uptime guarantee, affected customers may be eligible for service credits, as outlined in our Service Level Agreement (SLA).

5. Intellectual Property

All content, trademarks, logos, software, and other materials provided through the Services are the property of RapidSDLC or our licensors. You are granted a limited, non‑exclusive, non‑transferable license to use the Services in accordance with these Terms.

6. Fees & Payments

  • If you subscribe to a paid plan, you agree to pay all applicable fees according to the terms presented at the time of purchase.
  • Payments are non‑refundable except where required by law.
  • We may change pricing upon reasonable notice.

7. Termination

  • We may suspend or terminate your access to the Services at any time if you breach these Terms, your use poses a risk to the security or stability of our Services, or you fail to pay applicable fees.
  • You may terminate your account at any time by contacting us at support@rapidsdlc.com.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

9. Limitation of Liability

To the maximum extent permitted by law: (a) RapidSDLC will not be liable for any indirect, incidental, special, consequential, or punitive damages; and (b) our total liability for all claims in connection with the Services will not exceed the amount paid by you to us in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless RapidSDLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Services or your violation of these Terms.

11. Modifications to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Services. Your continued use after such changes constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in [Your City/State].
